Experience

Munpreet is a solicitor in the Clinical Law Advisory team at Capsticks where her work covers the areas of Court of Protection, Public Law, and Information Law to a range of healthcare clients. Munpreet:

  • Regularly advises advising NHS organisations in respect of applications regarding patient capacity, consent and best interests are in dispute including serious medical treatment decisions, and treatment withdrawal. Regularly providing advice through our emergency out of hours service.
  • Advises and represents NHS Trusts and CCGs on a broad range of healthcare law matters, including representing clients in personal welfare applications such as authorisation for COVID-19 vaccination, challenges pursuant to s21A Mental Capacity Act 2005. In addition to representing CCG’s in relation to disputes regarding responsible commissioner status for s.117 aftercare, and matters regarding safeguarding concerns in the home and within a community package of care.
  • Completes and advises on applications to authorise Deprivation of Liberty in the community, including COP DOL11 applications.
  • Handles requests under data protection legislation and provides a wide range of advice on all areas of information law.
  • Advocating for acute trusts and CCGs at medical inquests.

Notable projects

  • Leading on complex welfare matters including complicated COVID vaccination applications with a judgement being made on the papers due to significant wealth of evidence provided to the Court.
  •  Leading on complex, multi-party, Tier 3 Court of Protection matters
  • Advising on a large-scale regulatory project
