Experience

Adil is a specialist employment lawyer who has practised employment law since qualifying as a solicitor in 2009. Prior to joining Capsticks, Adil was a Senior Employment Lawyer at the Government Legal Department where he acted for a number of central government departments on high profile litigation and sensitive advisory matters. Most recently Adil worked at a regional firm where he acted for NHS Trusts, NDPBs, independent schools, household name retailers and private healthcare providers.

Expertise

Adil advises and litigates on all aspects of employment law and is an accomplished litigator with a focus on complex discrimination and whistleblowing cases. He has litigated employment cases right up to the Supreme Court and the Court of Justice for the European Union.

Adil’s advisory practice involves supporting employers with  large-scale redundancies, TUPE, trade union matters and sensitive internal investigations.

Adil also drafts settlement agreements, contracts of employment and HR policies for his clients.

Adil regularly devises and delivers training on employment law to HR professionals and line managers. Recent training has involved whistleblowing, discrimination and providing employment law updates.

Notable projects

Cases

  • Lord Chancellor and another v McCloud and others, Secretary of State for the Home Department and others v Sargeant and others [2018] EWCA Civ 2844 – direct age discrimination and indirect race and sex discrimination claims resulting from the 2014/15 public sector pension reforms.
  • Essop & others v. Home Office [2017] UKSC 27- clarified the evidential burden for indirect discrimination claims.
  • O’Brien v. Ministry of Justice (CJEU) – sets out the law relating to retrospective rights under the Part Time Workers Directive.

Advisory

  • Advising an NHS Trust on the wide-ranging implications of the Supreme Court’s Harpur Trust v Brazel judgment and the subsequent correction through The Employment Rights (Amendment, Revocation and Transitional Provision) Regulations 2023.
  • Settling claims and potential claims worth £1.5m  in respect of historic annual leave entitlement created by King v. Sash Windows and Smith v. Pimlico Plumbers.
