Experience

Sean is a Partner in Capsticks’ national employment and pensions team.  Sean has specialised in employment law within the public sector (healthcare, local government and emergency services) since qualifying in 2016 and has six years’ experience prior to qualifying in advising on employment issues for public, private and third sector clients.

Sean leads on the firm’s offering for local government clients in the north of the country as well as being embedded into work with the firm’s ambulance sector clients.

Expertise

Sean is known for handling complex multi-day Employment Tribunal proceedings involving whistleblowing and/or discrimination. He has a particular expertise in giving advice on problematic employees across the spectrum of levels up to and including Executive Board level and regularly advises on high profile exits. He is known for being able to scope out a variety of practical options for his clients in order to reach their desired outcomes.

Sean has held the position of Co-Chair of Prism, the Capsticks LGBT+ Employee Network Group, as well as having sat for several years on the firm’s Equity, Diversity and Inclusion (EDI) Council, giving him a further practical insight into the working of EDI in the workplace.

Notable projects

  • Working on the practical implementation of holiday pay calculations and corrective payments in light of the decision in Flowers v East of England Ambulance Service.
  • Leading on the EAT appeal in the case of South West Yorkshire Partnership NHS Foundation Trust v Mr Jackson & Others, which considered the principles of causation in pregnancy and maternity discrimination claims.
  • Leading on the case of Bicknell and The BMA v Nottingham and Nottinghamshire ICB on the issue of the application of TUPE to public administrative reorganisations in the public sector.
  • Developing and implementing staff sharing agreement arrangements across public sector organisations.
