Michael is a partner with Capsticks specialising in housing management litigation for Registered Providers and Local Authorities. He also has experience of formerly acting for private landlords and tenants.

He advises social landlords nationally on all aspects of housing litigation from drafting and interpreting tenancy agreements and other documentation to advising on complex succession disputes, disrepair matters and high profile anti-social behaviour cases.

Michael also advises on public law and Human Rights Act challenges and in dealing with the Housing Ombudsman and complaints handling generally. He has also represented clients at Coroners Inquests and frequently oversees multi-agency approaches to resolving matters including through non contentious means.

Michael is often asked to speak at and chair national housing forums and conferences and has previously sat on charity boards.

Michael undertakes training nationally for clients and sector leaders such as the Chartered Institute of Housing, Social Landlords Crime and Nuisance Group, National Housing Federation, HouseMark, Lime Legal and Capita. He is also a regular contributor to the housing media.

Michael has been recommended to advise political parties on their anti-social behaviour policies and was invited to the Home Office as part of a stress-testing Group in regards to proposed new anti-social behaviour legislation.

Michael and his team are regularly involved in nationally reported high profile cases and as such is well versed in dealing with the media on behalf of social landlord clients. He has also undertaken large tenancy and policy reviews for some of the largest Registered Providers in the country and has led national discussion forums and roadshows on the implications of new legislation including flexible tenure and welfare benefit reform.

He is ranked as a leader in the sector in the Legal Directories and he and his team are regularly instructed to advise their national client base and others in the sector on the implications of new and anticipated legislation.

Notable Projects
  • Complete reviews of leading Registered Providers policies, procedures and tenancy agreements.
  • Hosted and spoke at nationally attended discussion forums on flexible tenure and Welfare Reform.
  • Along with the team, assisted a large national Registered Provider in tackling a complex anti-social behaviour case in preparation for the Olympic Games (allowing events in that area to proceed unaffected)
  • Chaired the CIH National Tenancy Conference
  • Successfully represented a social landlord on a high profile and extremely important housing benefit appeal
  • Along with the team, successfully obtained vacant possession of a large site to allow a multi-million improvement scheme to proceed on time.
