Experience

Lynsey is a Partner specialising in resolving commercial disputes.  She has over 25 years' dispute resolution experience acting for both public sector and private clients across a very broad range of issues and subject matters.

Expertise

Lynsey advises on commercial contract disputes and has extensive experience resolving disputes arising out of PFI/PPP arrangements, outsourcing contracts, service delivery issues and distressed infrastructure projects, including assisting clients with managing those contracts. 

Lynsey also has a particular focus on advising on procurement challenges and judicial review proceedings.

She also has acted for clients in the waste and energy sectors for many years.

She has extensive experience of all forms of litigation and alternative dispute resolution processes. As she has always acted for both public authorities and private contractors, she is able to take a rounded view of matters and offer invaluable insight into the mindset and considerations of all parties to a dispute.

Notable projects

Lynsey has advised on many notable matters, but some recent examples include:

  • Acting on behalf of a Local Authority on a series of adjudications leading to a reset of the relationship under a long-term PPP contract
  • Advising a Local Authority on judicial review proceedings against a central government body in relation to the siting of a proposed refugee centre
  • Acting for multi-national supplier in an arbitration to resolve disputes arising under the operation of a repair, maintenance and capital works social housing contract against a Local Authority
  • Acting on behalf of a large-scale waste management company in a number of adjudications and subsequent court proceedings relating to the interpretation of a payment mechanism in a waste PFI contract
  • Advising on procurement challenge proceedings by a supplier against a central government body challenging its decision on its procurement route as being unsuitable for the proposed use
