Experience

Emma is a Legal Director at Capsticks, having joined the team from DWF. She is a professional, experienced, technically strong solicitor who is always in the detail of each case she is working on.  She specialises in supporting a wide range of clients including healthcare providers, local authorities, social housing organisations, care homes and prison operators faced with high risk inquests, including cases where Article 2 is engaged and where there may be wider reputational issues at stake.

Emma’s experience of the associated civil/breach of Human Rights Act claims and complex casualty claims brought against health and justice providers and local authorities enables her to address all relevant issues at play in each case. In addition, Emma has experience of working on public inquiries and has a growing practice of Court of Protection and inherent jurisdiction cases for commissioning bodies and supporting organisations dealing with CQC inspections and enforcement action.   Expertise

Emma handles high risk Article 2 and non-article 2 inquests, Court of Protection cases, CQC queries, and general advisory queries for her clients.  She has been described by clients as a trusted legal advisor and prides herself on being responsive, proactive and providing measured practical advice. 

She is adept at supporting witnesses and the wider business through the inquest, public inquiry and court processes. Her work includes liaising with the client to secure relevant evidence and witness statements, advising the client on the risks and how to mitigate those risks and supporting the client to secure additional evidence as needed. She works closely with the client and the witnesses to prepare them to attend court hearings and works with clients following hearings to support them with any learning points identified. Emma also brings years of experience in breach of Human Rights Act claims and catastrophic personal injury matters.

Emma has worked closely with a client to provide support for a public inquiry, including preparation of complex witness statements and attending the hearing. 

As a strong relationship builder, clients see Emma as their ‘go-to’ problem solver to approach for practical and commercial advice.

CSR activity

Emma has previously been a trustee for a charity supporting learning disabled artists in Manchester.
