Experience
David is a Principal Associate, who since qualifying in 2012, has worked exclusively in litigation. David joined the Claims Division at Capsticks in 2020 where he is regularly instructed in the defence of high-value and complex claims; both clinical and non-clinical.
Expertise
David has a particular interest in claims involving issues of consent. David’s non-clinical practice involves advising NHS Trusts, ICBs, Government Departments and Insurers across a broad range of matters, with expertise in claims involving, the Equality Act, unlawful detention, human rights, death in custody, inpatient and community mental health, mesothelioma and Data Protection. David also has extensive experience acting in cases involving litigants in person.
David is known for providing commercially focused and pragmatic advice, working closely with clients to manage risk and resolve disputes efficiently and with minimal costs.
Alongside his practice, David regularly delivers training and presentations on a range of legal topics to healthcare professionals, students and other audiences, helping clients and stakeholders understand developments in the law and manage claims efficiently.

- ATE v (1) Totally PLC (2) Imperial College Healthcare NHS Trust. Successful defence of a Data Protection claim following a three day trial.
- RO v Camden & Islington NHS Foundation Trust. Successful defence of an alleged assault by a service user following a three day trial.
- AH v North Middlesex University Hospital NHS Trust. Successful defence at trial of an alleged failure to diagnose and treat the Claimant’s wrist fracture.
- MM v London North West University Healthcare NHS Trust. Successful defence at trial in an employer liability matter where the Claimant alleged a failure to provide suitable training and equipment.
- NOC v University Hospital Sussex NHS Foundation Trust. Successful pre-trial resolution of a neurological injury claim with a capitalised settlement in excess of £20m.
- SA v Croydon Health Service NHS Trust. Successful pre-trial resolution of a wrongful birth claim in excess of £10m.
