Andrew Rowland


Andrew studied at Nottingham before starting his training with Capsticks in September 1996. He qualified into the Employment Department in September 1998 and became a Partner in July 2004.

Andrew has a specific interest in doctor cases and “Maintaining High Professional Standards”. He handles High Court cases arising out of MHPS, provides training to HR professionals/managers on conducting investigations under MHPS and speaks about MHPS at national conferences. He advised on the High Court cases of Kerslake v The North West London Hospitals NHS Trust and Fynes v St George’s Healthcare NHS Trust. He also acted for the National Clinical Assessment Service (as an intervening party) in the recent High Court case of Chakrabarty v Ipswich Hospitals NHS Trust.

Andrew is advising provider trusts on potential changes to national terms and conditions, the process that need to be followed to achieve this and associated industrial relations issues with the unions. His work in this area has led to ground-breaking instructions from new clients and consortia, keen to explore ways of achieving change. Andrew also provides employment advice for emergency services clients.

Andrew deals regularly with high-level executive terminations, ensuring that robust compromise agreements are in place and the necessary approvals obtained. He also handles clients’ most sensitive Employment Tribunal and High Court cases, including complex discrimination and whistleblowing claims involving senior managers and doctors.
