James is a partner in the Regulatory Division, having joined Capsticks from the Bar in 2007. He has extensive experience of conducting and supervising investigations on behalf of regulatory bodies, principally the General Dental Council, the Health and Care Professions Council, the Nursing and Midwifery Council and the Solicitors Regulation Authority.
James leads a team of lawyers and paralegals investigating and preparing professional disciplinary cases for consideration at a preliminary stage and for hearing. His work often involves the conduct of complex, high profile and sensitive cases. James has extensive experience of handling regulatory cases in the High Court, including judicial reviews, challenges to interventions into solicitors’ firms and appeals.
In addition, James provides advice on a range of legal issues in regulatory cases, including the application of the Data Protection Act, the European Convention on Human Rights and the common law duty of confidence. James delivers bespoke training sessions to in-house teams and has also appeared as an advocate before the committees of regulators.
