Emma Pollard


Emma is a solicitor in the Capsticks’ Public Law and Healthcare Advisory team. Emma advises on a wide range of issues including Court of Protection cases relating to Deprivation of Liberty, patient complaints and serious incident reports.

Emma also advises on Judicial Review challenges arising from alleged non-compliances of clients with their statutory obligations and powers. Emma has experience of advising on service reconfiguration, including relevant engagement/consultation duties and the duties of clients under the Equality Act 2010.

As a member of the Capsticks Information Law team Emma provides clients with advice on their obligations under the Freedom of Information Act 2000 and the Data Protection Act 1998, in addition to the common law obligations of confidentiality and obligations under Article 8 ECHR.

Notable projects
  • Managed a challenging three day hearing in the High Court relating to Deprivation of Liberty. Our client, an NHS Trust, was granted an Order allowing them to proceed with a caesarean section on a heavily pregnant patient with severe learning disabilities.
  • Advised a Clinical Commissioning Group (“CCG”) client on its public engagement process prior to the implementation of an Accountable Care Organisation.
  • Advised a CCG client on disputes with other CCGs over funding.
  • Advised on the implications of the Data Protection Act 1998, particularly in relation to Subject Access Requests.
  • Advised on how best to challenge the ratings given in a Care Quality Commission (“CQC”) report.
