Bridget Stark-Wills


Bridget is an Associate at Capsticks specialising in housing and leasehold management and litigation for registered providers. She also assists social landlords with general property litigation matters in both residential and commercial contexts.

Bridget practised with a large Midlands firm before joining Capsticks in April 2016, where she works with the Housing Management and Asset Management Teams.

She is experienced in dealing with all aspects of housing management, including section 8 and section 21 possession claims, tenancy breaches, termination of excluded and protected licence agreements, anti-social behaviour injunction and possession claims, committal applications, succession claims, disrepair claims and counterclaims, eviction of squatters  and tenancy fraud. Bridget also advises social landlords in respect of challenges under the Equality Act and Human Rights legislation. She also often assists clients in the drafting of policies, procedures, tenancy and licence agreements and management agreements.

In respect of her leasehold management practice, Bridget advises and assists registered providers   on the following:

  • Service charge management, including budget setting, development of arrears recovery policies and procedures, requests under sections 21 and 22 of the Landlord & Tenant Act 1985 and conducting section 20 consultation procedures.
  • Service charge arrears recovery, including acting in respect of applications to the First-tier Tribunal (Property Chamber) and subsequent forfeiture proceedings.
  • Forfeiture and breach of covenant proceedings, for example, in relation to subletting, disrepair, anti-social behaviour, unlawful use and unauthorised alterations.
  • Lease variation applications, RTM applications and disputes, contested lease extensions, applications to appoint a manager and applications for dispensation.
  • Interpretation and application of lease provisions.
  • Drafting management agreements, terminating such agreements, and assisting in the resolution of disputes with management companies and managing agents.

Bridget has a particular interest in shared ownership and her advice includes:

  • Dealing with and managing persistent non-payment of rent issues and the impact on potential claims under the mortgagee protection clause.
  • Forfeiture and Housing Act 1988 possession proceedings.
  • Designing bespoke rent arrears recovery processes and policies and procedures on issues such as disrepair and subletting.
  • Challenges under the Equality Act 2010 and the Human Rights legislation.

Bridget also frequently advises clients on  the legislation on the Right to Buy/Right to Acquire and assists with disputed applications. She has detailed knowledge of estate rent charges that are reserved in freehold transfers made following the exercise of these rights and assists clients in the management and recovery of such charges, as well as the resolution of disputes.

In relation to property litigation, Bridget acts for clients in   disputes regarding boundaries, rights of way, rights to light, adverse possession, enforcement of restrictive covenants and party wall matters.

Bridget enjoys delivering training courses to her clients on all areas of her practice.
