Andrew joined Capsticks in March 2014 as an Associate in the firm’s national employment team. Based in Leeds, Andrew works with health, public sector and third sector clients on employment and immigration issues.
Andrew is regarded as a pragmatic adviser focussed on providing practical solutions to clients rather than simply legal advice. One NHS client said “we like you because we tell you what we need and you tell us how to do it rather than saying it can’t be done”.
His practice includes advising on complex whistleblowing and discrimination claims, TUPE, industrial relations issues, organisational change, and disciplinary issues relating to doctors and senior employees. Andrew also advises on right to work issues; IR35 and the use of personal service companies along with agency and other atypical working relationships.
Acted for an NHS FT in their successful appeal against a Tribunal judgment that it could be liable for the failings of other NHS organisations to make adjustments for disabled staff.
Advising and representing a national health organisation on restructuring its work force and working arrangements while minimising risk of legal claims.
