NHS commissioners: office holder status – governing body members and clinical leads

Commissioners have key roles in coordinating the NHS recovery following the COVID-19 peak and driving the changes needed to embed system-based working in the NHS. In order to fulfil these roles successfully, CCGs and CSUs need access to experienced lawyers who specialise in the legal issues that particularly apply to commissioners. We have therefore asked members of our expert commissioning team to share with you their insights into some of the major challenges you are likely to face during the next phase of NHS commissioning, and their practical tips for how you can overcome those challenges.

We will explore some of the key employment law issues for CCGs looking at the status of Governing Body Members and Clinical Leads and how to ensure that contracts are correctly categorised whilst meeting pension and IR35 responsibilities as well issues relating to mergers and staff transfers.
