Governance

Examples of our work in this area

  • We represented the Foundation Trust Network of the NHS Confederation during the judicial review proceedings Unison brought against Monitor. Prior to the actual hearing, which found Monitor needed to recover its private patient cap definition, the Government was persuaded to undertake an urgent review of the legislation on the private patient cap as it was no longer fit for purpose.
  • Independent review of management and governance at the Royal Cornwall Hospital NHS Trust - advising the team, led by Professor Ruth Hawker OBE, undertaking the Review on the legal issues arising from their investigation. This included putting in place proper protection from legal challenge for the team and then advising on the draft report and the verification process, prior to handing it over to the commissioners for publication.
  • Supporting Healthcare for London in the largest ever reconfiguration of NHS services which is transforming health services across the capital. Work which has included developing a governance process by which 31 PCTs can make decisions for the collective benefit of people in the London area.
  • We have worked on the governance arrangements for academic health science centres including advising Imperial College Healthcare NHS Trust on its relationship with Imperial College and its application for foundation trust status; and advising Kings Health Partners on its protocol for staff working across organisational boundaries.
  • We have also recently advised financially challenged NHS bodies on their decision making processes and obligations, whilst maintaining the provision of health services.  This has included advice on organisational and individual exposure on difficult choices over providing health services for the collective benefit of people in the London area.
