We advised and represented a high-profile foundation trust in responding to allegations of fraudulent conduct by a very senior clinician, giving rise to issues for the Trust across a number of areas including: handling employment law issues; advice on recovery of sums lost through fraud; stakeholder confidence among an active and high-profile group involved in charitable work with the FT; defending multiple claims by commercial stakeholders.
We prosecuted, on behalf of a regulator, a fraud case in which a CPS criminal prosecution had failed; we “re-investigated” the case and successfully brought it before a professional disciplinary tribunal, which found the facts proved the practitioner guilty of serious professional misconduct.
A dentist was convicted of having fraudulently claimed over £400,000 from the NHS for private services. Capsticks were instructed to pursue recovery of the losses. We obtained a Court Order requiring disclosure of all assets, secured the suspension of insolvency processes because of irregularities in information provided, and secured a substantial lump sum repayment including sums from a pension fund.
