Investigations – we investigate and prepare hundreds of cases annually for a variety of different regulators including our own regulator, the Solicitors Regulation Authority, and a number of the statutory healthcare regulators (including the General Dental Council, the General Pharmaceutical Council and the Nursing and Midwifery Council). Using advanced case management technology and techniques honed over our many years of experience, we are skilled in providing high quality, targeted and proportionate investigations which are delivered on time and cost efficiently. Appeals and judicial reviews – we frequently advise on and have experience of handling statutory appeals and judicial review applications before the High Court and Court of Appeal. We also advise the Professional Standards Authority for Health and Social Care, the umbrella organisation established to promote best practice and consistency in the regulation of healthcare professionals, on their statutory appeals.
Advocacy – we have a specialist team of in-house advocates, both barristers and solicitors, who appear regularly before all forms of disciplinary tribunals and the Courts. Training – we regularly devise and deliver interactive and bespoke training to the in house teams at our regulatory clients or their committees, on matters such as legislative changes, case law updates, or the implementation of new guidance.
Policy and guidance – we recognise that the review and implementation of guidance is crucial to streamlining processes and ensuring effective regulation. We regularly draft policy and guidance documents for our regulator clients.
Information law – we have a specialist team who provide advice and guidance to regulators on their responsibilities under and compliance with the Data Protection Act, as well as supporting them in responding to requests made under the Freedom of Information Act and advising on confidentiality issues.
Capsticks’ Business Solutions – we understand that our clients often need a more flexible legal offering or solutions that go beyond legal advice, and so we have brought together a team of regulatory specialists under the umbrella of Capsticks’ Business Solutions. These specialists have reviewed processes and procedures of regulators in various sectors, in particular to improve efficiencies and timelines. Defendant work - alongside our established practice of working for regulators, we have a growing practice in representing registrants facing disciplinary proceedings before their national regulators. We regularly receive instructions via a major defence organisation, Lloyd’s underwriters and individuals themselves.
