Outsourcing and joint venturing

Our Outsourcing team has worked on a wide variety of joint ventures, shared services and partnering arrangements and can help you deliver the QIPP agenda for your organisation.

In a landscape where there is increasing pressure on NHS organisations to reduce costs and improve performance, it is important to structure your deal correctly so that it doesn't end up costing your organisation more.  We will help you get a deal that achieves productivity gains and delivers value whether it relates to pathology, decontamination, estates, back office functions, local authority arrangements or shared clinical provision.

All projects are different but we can use our experience to help save you money and deliver your project on time.

We can:

Help you to plan early and consider procurement law implications

We can assist you with your timetable and project planning so your internal and external resources work together as a joint team.  We will help you understand the procurement law implications for your project and work out whether any exemptions apply.

Commercially structure your project

We will help you choose the right shared services structure for your organisation and advise on all aspects of the formation.  We will draft and negotiate all necessary documentation and provide comprehensive advice on the formation of joint ventures.

Advise on the implications for your Estate

We can help you 'get your house in order' through regularising occupational arrangements.  We can assist you in implementing an electronic estates management database for pooled estates management.  We can promote cost efficiencies through best practice and NHS Estatecode compliance.

Understand the effect on your workforce

We will help you to identify staff who will be affected by any TUPE transfer and advise on the implications of the Cabinet Office Guidance on Staff Transfers in the Public Sector.  We will work with you to establish a good relationship with the union representatives.  We will help you work with new providers to ensure that any transition is as smooth as possible and that all pension issues are resolved at an early stage.

“Capsticks provides a service that is more than just the 'legals'. They understand the business pressures on us as a foundation trust, and have a range of solutions that are delivered in a joined-up way. They make their advice accessible across our organisation in a tailored way that makes sense to end-users.”

Mary Edwards, Chief Executive, Hampshire Hospitals NHS Foundation Trust
