Estates and site developments
Our expert property law team is experienced in acting for emergency services over many years, and we’re aware of the specialist requirements you have regarding your estate. For example, it’s critical that your operational ambulance and fire station sites have 24/7 access to the nearest public highway.
Our close and longstanding links with government and regulators ensure we keep you up to date with the latest policy and legal developments that are relevant to you. We are aware of your unique requirements regarding security, keeping of firearms and other facilities like stables and dog training centres.
We have a wealth of experience on all aspects of estates transactions and advice for our emergency service and public sector clients. This means you can be assured that as one of the largest dedicated emergency services and public sector estates teams in the country you will always have a high quality “safe pair of hands” to deliver your estates projects on time and in budget.
We are, for example, used to advising on the transfer of property following the recent reorganisations with the introduction of Police and Crime Commissioners. Forces are now required, as never before, to think strategically about the use of their estate, which in some cases can be extensive. We regularly advise and support our emergency services clients on:
New emergency services station or depot developments, including expert input on heads of terms, dealing with title issues, negotiating Section 106 Agreements, site acquisition contracts, development agreements, building contracts and the entire remit of supply chain agreements for the construction of the new development;
Negotiating leases (whether you are the landlord or, as is more common with most emergency services, the tenant) of your facilities, and regularising your occupational arrangements to transfer risk away from you where it is possible to do so;
Site disposals, including advice on overage and clawback protections, support on preparing sales and marketing packs, and negotiating the sale contract and transfer with your buyer;
Property litigation - advice on unauthorised third part occupiers at your redundant or mothballed sites, recovering vacant possession from squatters, and advice on public liability and Health and Safety issues for your estate.
