Emily deals with a wide range of public law, healthcare advisory and information governance matters.
Emily advises NHS and social housing organisations on their various statutory obligations and powers, and deals with Judicial Review challenges arising from alleged non-compliance. In particular, Emily has experience of advising on engagement/consultation obligations, and duties under the Equality Act 2010. Emily was seconded to NHS England during the CCG authorisation process, and advises CCGs on their constitutional and governance requirements, including conflicts of interest. Emily also provides policy advice to clients on various matters, including the Continuing Healthcare Framework, Individual Funding Requests and incident reporting.
As a member of the Capsticks Information Law team Emily provides clients with advice on their obligations under the Freedom of Information Act 2000 and the Data Protection Act 1998, in addition to the common law obligations of confidentiality and obligations under Article 8 ECHR. Emily has experience of responding to complaints made to the Information Commissioner and preparing cases for the Information Tribunal. Emily has also assisted clients with developing their policies in respect of surveillance and noise monitoring, and advised on removal of information from social media websites.
Emily also has experience of the regulatory sector, and undertook a secondment with a healthcare regulator during her training contract. Emily provides advice to NHS bodies on Care Quality Commission (CQC) reports, along with post-inspection support.
